Building & Zoning
The City of Cascade adopted and implemented zoning in 1978. The purpose of the City’s zoning is to ensure compatible land uses and orderly development in the city. The Cascade zoning ordinance is administered by the Zoning Administrator, the Planning and Zoning Commission, and the Zoning Board of Adjustment. The Zoning Administrator enforces the provisions of the City’s zoning ordinance, as wells as the subdivision ordinance and floodplain ordinance. The Zoning Administrator also issues building permits and floodplain development permits in conformance with these ordinances.
The Planning and Zoning Commission is a seven member advisory board appointed by the City Council to advise the Council on land use and development matters. It reviews and makes recommend actions to the City Council on rezoning requests, subdivision plans, plats-of-surveys, annexations, vacation of streets and alleys, and amendments to the zoning, subdivision, and floodplain ordinances. The Commission also develops and updates the Cascade Land Use Plan once every 5-years. The commission usually meets every month and receives compensation of $15.00 per meeting.
The Zoning Board of Adjustment is a five member board appointed by the City Council which reviews requests for variances to the specific requirements of zoning and floodplain ordinances, special exceptions and conditional uses allowed in the zoning and floodplain ordinances, and interpretations to the meaning of provisions in the zoning and floodplain ordinances. The Board’s proceedings are quasi-judicial in nature. Its decisions are final and can only be overturned by an appeal to District Court.

“Simple Subdivision” is defined as any subdivision in which no new streets, public or private, are proposed; which does not require the construction of any public improvement; and which contains fewer than three (3) lots.
“Minor Subdivision” is defined as any subdivision in which no new streets, public or private, are proposed; which does not require the construction of any public improvement; and which contains three (3) or more lots.
“Major Subdivision” is defined as any subdivision which is not a simple subdivision or a minor subdivision.
Subdivision Review Process:
Simple subdivisions shall be reviewed by the Zoning Administrator to determine compliance with the Code of Ordinance of the City of Cascade. The Zoning Administrator shall require and enforce conditions to provide that the simple subdivision meets the requirement of Code of Ordinance of the City of Cascade. Review by the Planning and Zoning Commission and City Council shall not be required. No simple subdivision shall be recorded unless the Zoning Administrator has approved the plat. Fees for the review of simple subdivision shall be shall be set by resolution of the City Council from time-to-time.
Minor subdivisions shall be reviewed and approved by the Planning & Zoning Commission and City Council per the requirements hereinafter set forth. A preliminary plat is not required for a minor subdivision. However, the Planning & Zoning Commission may, in special circumstances where the Commission feels that the final plat does not convey enough information to adequately review the subdivision, move to require additional information or a complete preliminary plat. A minor subdivision may also be approved by the Zoning Administrator provided that such subdivision has been previously reviewed and approved as part of larger minor or major subdivision by the Planning & Zoning Commission and City Council. Fees for the review of a minor subdivisions shall be shall be set by resolution of the City Council from time-to-time.
Major subdivisions shall require a preliminary plat and final plat as prescribed in Sections 166.05 and 166.10 of this Chapter and review and approval of Planning & Zoning Commission and City Council per the requirements hereinafter set forth. In addition, a pre-application conference with a committee of the City Council shall be required to acquaint the affected parties with the proposed subdivision, the City’s subdivision requirements, and to outline the subdivision review and approval process. Fees for the review of a major subdivision shall be set by resolution of the City Council from time-to-time.
